CCMR3 offers the following language access services to New York City consumers: The option to speak with a representative in English or Spanish. In addition, a translation and description of commonly-used debt collection terms is available in multiple languages on the NYC Department of Consumer Affairs website,www.nyc.gov/dca.
Our privacy statement includes privacy practices CCMR3 follows with respect to your Personal Identifiable Information (PII), collected and is organized as follows by:

Business Customer: A business customer is an entity or sole proprietor who has entered into an ongoing relationship with CCMR3 through a services agreement. As it relates to privacy laws and regulations, the business customer is considered the “data controller”.
Consumer: An individual who is a consumer of the business customer whose account information is sent to CCMR3 in order to perform business activities. As it relates to privacy laws and regulations, the consumer is considered the “data subject”.

THE SITE

During the collection of information on the “Get Started“, “Subscription” or “Contact“ sections of our web site, users are required to give their contact information (such as name and e-mail address). E-mail address is primarily used to confirm the identity of the user. This information is also used to contact the users about the services on our site for which they have expressed interest.
CHILDREN’S AND MINOR’S PRIVACY
“CCMR3“ strongly encourages parents and guardians to supervise the online activities of their minor children and consider using parental control tools available from online services and software manufacturers to help provide a child-friendly online environment. - A minor’s parent or legal guardian may request “CCMR3“ to provide a description of the personally identifiable information that “CCMR3“ has collected from the minor, as well as instruct “CCMR3“ to cease further use, maintenance and collection of personally identifiable information from the minor.

Users of www.capitalcollect.com may opt-out of receiving communications from “CCMR3“ at the point where “CCMR3“ requests personally identifiable information about the use. WHAT PERSONALLY IDENTIFIABLE INFORMATION OF YOURS IS COLLECTED THROUGH THE CCMR3 SERVICES

The CCMR3 Services are not part of the Site. CCMR3 serves as a data processor for its business customers who use these services. CCMR3 does not own the information that is submitted to its’ business customers. The information that is submitted to its business customers will be subject to its business customers’ privacy policies.
In providing the CCMR3 Services, CCMR3 must process PII in order to conduct business activities. In most cases, this PII is sent to CCMR3 via encrypted email from their business customer. This PII includes names, addresses, email addresses, date of birth, social security number, and phone numbers. CCMR3 processes this information to ensure they are able to contact the accurate consumer to conduct the services the business customer is contracted for, and in order to verify the identity of the consumer to conduct business activities in accordance with applicable laws and regulations. Consequences of refusing to verify your PII during business activities might result in CCMR3 being unable to perform the CCMR3 Services.
CONSENT
A consumer inexplicitly consents to having their PII processed by CCMR3 through using our business customers’ services. CCMR3 only uses consumers’ PII for the purposes for which it has been collected from the business customers. It is the responsibility of the business customers to obtain explicit consent for the collection, use, and disclosure of a consumer’s PII and is subject to their privacy policies.

As part of CCMR3’s services we may contract with third-party providers to perform certain functions of our business activities. An example includes using a third-party payment processing provider. In cases of onward transfer to third parties of PII, CCMR3 is potentially liable. These third parties may have access to PII to the extent necessary to permit them to do their jobs, however, they are bound by confidentiality agreements or similar contractual restrictions before any information is provided to them, and they are restricted from using the information for other purposes. CCMR3 contracts with third parties to ensure that such data may only be processed for limited and specific purposes consistent with law, and that the recipient will provide the same level of protection as is required by applicable law.
ACCESSING OR CORRECTING INACCURACIES FROM THE USE OF THE CCMR3 SITE
Keeping your account information accurate and up to date is very important. You have access to your account information, which includes your contact information, account balances and transactions and similar information, which we provide to you through various means and in response to specific requests. If your account information is incomplete, inaccurate or not current, please call or write to us at the telephone number or appropriate address for such changes listed on your account statement or other account materials. RETENTION
CCMR3 retains the PII it processes in accordance with applicable laws and regulations.
LEGAL REQUESTS
“CCMR3“ cooperates with law enforcement inquiries, as well as other third parties, to enforce laws and third-party rights, such as intellectual property rights and laws relating to fraud. Therefore, in response to a verified request by law enforcement or other government officials relating to a criminal investigation or alleged illegal activity, or other activity that may expose us or you to legal liability, we can (and you authorize us to) disclose your PII and other information about you as we, in our sole discretion, believe necessary or appropriate.
NOTIFICATION OF CHANGES
If we decide to change our privacy policy, we will post those changes on default so our users are always aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. If at any point we decide to use personally identifiable information in a manner different from that stated at the time it was collected, we will notify users by way of an e-mail. Users which have provided personally identifiable information before the changes in our privacy policy will have a choice as to whether or not we use their information in this different manner.
